Services
Prooperty.com provides an online property-information and communication
Platform that allows Users to search for Properties, publish Listings, submit
inquiries, and communicate with property owners, brokers, agents, builders,
developers, and other Listing providers.
a. Role of Prooperty.com
Unless expressly stated in a separate written agreement, Prooperty.com
acts as a digital information and communication facilitator.
The Platform enables Users to:
- Discover
property information
- Publish
property advertisements
- Submit
inquiries
- Exchange
contact details
- Communicate
with Listing providers and
- Access
property-related digital tools or information.
Prooperty.com does not become a party to a transaction merely because
Users connect or communicate through the Platform. Any sale, purchase, lease, licence,
rent, booking, brokerage arrangement, or other property-related transaction is
entered into independently between the relevant Users. Unless expressly agreed
otherwise in writing, Prooperty.com does not act as:
- A
property owner
- A
buyer or seller
- A
landlord or tenant
- A
broker or agent
- A
legal advisor
- A
financial advisor
- A
property valuer
- A
title investigator or
- A
party to an agreement between Users.
b. No Guarantee of a
Transaction or Commercial Result
The publication of a Listing, purchase of a Paid Service, or submission
of an inquiry does not guarantee:
- The
sale, purchase, lease, or rental of a Property
- A
particular number of leads, inquiries, views, or responses
- Successful
communication or negotiation between Users
- The
availability of an advertised Property
- Approval
of financing, documentation, or registration
- Completion
of a property transaction
- A
particular sale price, rental value, or commercial outcome or
- The
suitability of a Property for a User’s requirements.
Paid Services provide only the features, duration, placement, promotion,
or visibility described at the time of purchase.
c. User-Submitted Property
Information
A significant portion of the information displayed on the Platform may
be submitted by:
- Property
owners
- Brokers
or agents
- Builders
or developers
- Advertisers
- Authorised
representatives or
- Other
Users.
Prooperty.com may apply moderation, screening, review, or verification
procedures. However, such procedures may be limited to the information,
documents, photographs, and representations made available to Prooperty.com.
Unless expressly confirmed in writing, Prooperty.com does not
independently certify or guarantee:
- Legal
ownership or title
- The
authority of the person advertising the Property
- The
accuracy of the advertised price
- The
dimensions, boundaries, area, or layout of the Property
- The
condition, construction quality, or completion status of the Property
- The
availability of licences, approvals, permissions, or occupancy documents
- The
absence of disputes, claims, mortgages, charges, or encumbrances
- The
accuracy or current status of photographs, videos, maps, or descriptions
- The
availability of advertised amenities
- The
legality or regulatory status of a project
- The
suitability of the Property for any particular purpose or
- The
authenticity of every statement made by a User.
d. Verification Labels and
Indicators
The Platform may display labels such as:
- “Verified”
- “Reviewed”
- “Checked”
- “Owner
Listing”
- “Agent
Listing” or
- Similar
indicators.
Any such label refers only to the specific review or verification
process completed by Prooperty.com at the relevant time.
A verification label must not be treated as:
- A
legal title certificate
- A
guarantee of ownership
- A
property valuation
- A
structural inspection report
- A
legal due diligence report
- A
regulatory approval
- A
guarantee against fraud
- A
confirmation that the Property is free from disputes or
- An
assurance that all information is complete and accurate.
Users remain responsible for conducting independent verification before
making any decision or payment.
e. Independent Due
Diligence
Before making a payment, signing a document, sharing sensitive
information, or entering into a property-related transaction, Users should
independently verify all material information.
Appropriate due diligence may include:
- Physically
inspecting the Property
- Confirming
the identity of the Owner, Broker, Agent, or representative
- Verifying
title and ownership documents
- Reviewing
sale deeds, lease documents, and related records
- Checking
applicable licences, permissions, and approvals
- Checking
for mortgages, charges, disputes, claims, or encumbrances
- Confirming
the Property’s location, dimensions, condition, and amenities
- Verifying
the authority of the person offering the Property
- Reviewing
brokerage fees, taxes, registration charges, and other costs
- Obtaining
independent legal advice
- Obtaining
technical or structural advice
- Obtaining
financial or taxation advice and
- Recording
agreed terms in legally enforceable documentation.
The User is solely responsible for deciding whether a Listing, Property,
representative, or proposed transaction is genuine, lawful, accurate, and
suitable.
f. No Professional Advice
Content available on the Platform is provided for general informational,
promotional, and property-discovery purposes. Unless expressly agreed through a
separate written engagement, nothing published or communicated through the
Platform constitutes:
- Legal
advice
- Financial
advice
- Investment
advice
- Tax
advice
- Property
valuation
- Title
certification
- Structural
certification
- Regulatory
approval or
- A
recommendation to enter into a specific transaction.
Users should consult appropriately qualified professionals before making
any legal, financial, investment, or property-related decision.
g. Communication Between
Users
Prooperty.com may provide tools that allow Users to:
- Submit
inquiries
- Exchange
messages
- Share
contact information
- Request
property details or
- Communicate
with Listing providers.
Prooperty.com does not control or guarantee the conduct, identity,
representations, commitments, availability, or responses of Users. Each User
must independently assess the identity, authority, reliability, and credibility
of any person with whom they communicate. Users should avoid making advance
payments or sharing confidential, banking, identity, or financial information
without completing appropriate verification.
h. Modification or
Discontinuation of Services
Prooperty.com may introduce, modify, restrict, suspend, or discontinue
any feature or Service where reasonably required for:
- Operational
reasons
- Commercial
reasons
- Legal
or regulatory compliance
- Technical
maintenance
- Security
requirements
- Platform
improvements or
- Prevention
of misuse or fraud.
Prooperty.com does not guarantee that every feature or Service will
remain continuously available, operate without interruption, or remain
identical across all devices, locations, or user categories.
5. User Accounts and
Registration
Certain features of the Platform may require a User to create and
maintain an Account. These features may include posting or managing Listings,
submitting inquiries, saving Properties, accessing Paid Services, receiving
communications, and using other account-based tools.
a. Account Registration
To create an Account, you may be required to provide information such
as:
- Your
full name
- Mobile
number
- Email
address
- Business
or organisation name
- User
category
- Property-related
details
- Location
- Identity
or verification information and
- Any
other information reasonably required to provide the Services.
You agree that all information submitted during registration shall be
accurate, current, complete, and not misleading.
You must not create an Account using:
- False
or fictitious information
- Another
person’s identity without lawful authority
- An
unauthorised business or organisation name
- Incorrect
contact information
- Temporary
or misleading contact details or
- Information
intended to conceal your actual identity or role.
b. Account Verification
Prooperty.com may verify an Account through one or more methods,
including:
- One-time
password verification
- Email
verification
- Telephone
confirmation
- Identity
verification
- Business
verification
- Property
document review
- Broker
or Agent verification
- Builder
or Developer verification or
- Any
other reasonable verification process.
Completion of a verification process does not constitute a guarantee
that all information submitted by the User is genuine, complete, or permanently
accurate. Prooperty.com may request additional information or documentation
where reasonably necessary to:
- Confirm
a User’s identity
- Verify
authority to post a Listing
- Prevent
fraud or impersonation
- Investigate
a complaint
- Comply
with Applicable Law
- Protect
other Users or
- Maintain
the security and integrity of the Platform.
Failure to provide requested information may result in restriction,
suspension, rejection, or removal of the Account or Listing.
c. Account Credentials and
Security
You are responsible for maintaining the confidentiality and security of
your Account credentials.
You must:
- Create
and maintain secure login credentials
- Keep
passwords and verification codes confidential
- Prevent
unauthorised persons from accessing your Account
- Log
out after using the Platform on a shared or public device
- Notify
Prooperty.com promptly of suspected misuse or unauthorised access and
- Take
reasonable steps to secure the device, email address, and mobile number
connected to your Account.
You must not sell, transfer, rent, license, or share your Account with
another person without prior written permission from Prooperty.com. Any
activity conducted through your Account may be treated as activity authorised
by you, unless you have previously notified Prooperty.com of unauthorised
access and taken reasonable steps to secure the Account.
d. Responsibility for
Account Activity
You are responsible for:
- Listings
published through your Account
- Messages
and inquiries sent through your Account
- Information
shared with other Users
- Paid
Services purchased through your Account
- Actions
taken by persons permitted to access your Account and
- Compliance
with these Terms & Conditions.
Where an Account is operated on behalf of a business, brokerage, agency,
Builder, Developer, or other organisation, that entity shall also be
responsible for all activity carried out through the Account by its employees,
representatives, contractors, or authorised users.
e. One Account per User or
Business
Prooperty.com may restrict the creation of multiple Accounts by the same
person, business, mobile number, email address, device, or organisation where
such Accounts are created to:
- Avoid
verification requirements
- Circumvent
restrictions or suspension
- Duplicate
Listings
- Manipulate
search visibility
- Mislead
other Users
- Obtain
repeated promotional benefits or
- Engage
in fraudulent or abusive activity.
Prooperty.com may combine, restrict, suspend, or remove duplicate or
related Accounts where reasonably necessary.
f. Account Updates
You must ensure that your Account information remains current and
accurate.
You should promptly update information relating to:
- Contact
details
- Business
details
- User
category
- Property
authority
- Brokerage
status
- Registration
details
- Account
representatives and
- Any
other material information.
Prooperty.com shall not be responsible for missed communications or
service disruption resulting from outdated, incomplete, or incorrect Account
information.
g. Account Suspension or
Termination
Prooperty.com may suspend, restrict, deactivate, or terminate an Account
where there are reasonable grounds to believe that:
- The
Account contains false or misleading information
- The
User has submitted fraudulent or unauthorised Listings
- The
Account has been compromised
- The
User has violated these Terms & Conditions
- The
Account is being used to send spam or unsolicited communications
- The
User has attempted to manipulate Platform features
- The
User has failed to complete required verification
- The
Account poses a risk to other Users or the Platform
- The User
has failed to pay an applicable fee or
- Suspension
or termination is required under Applicable Law.
Where appropriate, Prooperty.com may provide the User with an
opportunity to clarify the matter or submit supporting information. However,
immediate action may be taken where necessary to prevent fraud, security
threats, legal violations, or harm to another User.
6. User Obligations and
Content Submission Standards
Users may be permitted to submit Listings, photographs, videos,
descriptions, contact details, documents, reviews, messages, and other User
Content through the Platform. By submitting User Content, you confirm that you
have the legal right and authority to submit and use that Content.
a. Accuracy of Property
Information
All property-related information submitted by you must be accurate,
current, complete, and capable of reasonable verification.
This includes information relating to:
- Property
location
- Property
type
- Ownership
or authority
- Price
or rental amount
- Area
and measurements
- Construction
status
- Availability
- Amenities
- Furnishing
status
- Floor
details
- Project
details
- Approvals
and permissions
- Photographs
and videos and
- Additional
charges or conditions.
You must not knowingly omit material information where such omission may
mislead another User.
b. Authority to Submit a
Listing
You may submit a Listing only where you are:
- The
lawful Owner of the Property
- Authorised
by the Owner
- An
authorised Broker or Agent
- An
authorised representative of a Builder or Developer
- Legally
permitted to advertise the Property or
- Otherwise
entitled to publish the Listing.
Prooperty.com may require evidence of ownership, authority, appointment,
or representation before publishing or continuing to display a Listing.
c. Property Measurements
and Descriptions
Property measurements must be stated using clear and commonly understood
units. Where applicable, you should clearly distinguish between:
- Carpet
area
- Built-up
area
- Super
built-up area
- Plot
area
- Land
area and
- Any
other measurement category.
You must not exaggerate, manipulate, or incorrectly describe:
- Property
size
- Number
of rooms
- Location
- View
- Access
- Amenities
- Construction
quality
- Development
status or
- Distance
from landmarks.
d. Photographs, Videos, and
Visual Content
Photographs, videos, floor plans, and other visual material submitted
with a Listing must relate to the advertised Property or project.
You must not submit:
- Images
of an unrelated Property
- Artificially
altered images that materially misrepresent the Property
- Images
copied without permission
- Misleading
stock photographs presented as actual Property images
- Images
containing unauthorised personal information
- Images
intended to conceal material defects or
- Visual
Content that infringes intellectual property or privacy rights.
Where an image is digitally enhanced, indicative, representational, or
computer-generated, it should be identified appropriately where necessary to
avoid misleading Users.
e. Duplicate and Repetitive
Listings
You must not publish multiple Listings for the same Property in a manner
intended to:
- Manipulate
search results
- Create
false availability
- Gain
disproportionate visibility
- Mislead
Users about the number of available Properties or
- Circumvent
Listing limits.
Prooperty.com may merge, remove, reject, or reduce the visibility of
duplicate or substantially similar Listings.
f. Prohibited Content
You must not submit, publish, transmit, or share Content that:
- Is
false, fraudulent, deceptive, or misleading
- Violates
Applicable Law
- Infringes
intellectual property rights
- Violates
privacy or confidentiality
- Is
defamatory, threatening, abusive, or harassing
- Contains
obscene or sexually explicit material
- Promotes
violence or unlawful conduct
- Contains
malware, harmful code, or suspicious links
- Encourages
discrimination
- Misrepresents
ownership, authority, identity, or affiliation
- Promotes
an unlawful property transaction
- Contains
unauthorised financial or banking information
- Is
unrelated to the Services offered through the Platform or
- May
harm the reputation, security, or functioning of Prooperty.com.
g. Non-Discrimination
Listings and communications must comply with applicable
anti-discrimination principles and laws. Users must not publish Content that
unlawfully restricts, excludes, or expresses a preference against a person
based on characteristics such as:
- Religion
- Caste
- Race
- Community
- Ethnicity
- Gender
- Disability
- Marital
status or
- Any
other protected characteristic under Applicable Law.
This clause does not prevent a User from stating lawful and objectively relevant
occupancy, property-use, or eligibility requirements where permitted under
Applicable Law.
h. Communication Standards
When communicating with another User, you must:
- Provide
accurate information
- Communicate
respectfully
- Avoid
harassment or threats
- Avoid
repeated unwanted contact
- Refrain
from sending spam
- Avoid
requesting unnecessary sensitive information
- Clearly
disclose your role as Owner, Broker, Agent, Builder, or representative and
- Avoid
making guarantees or representations you are not authorised to make.
i. Prohibition on Automated
Data Collection
You must not use any automated or manual method to extract, reproduce,
download, monitor, collect, or copy Platform data without prior written
permission from Prooperty.com.
Prohibited methods include:
- Bots
- Crawlers
- Scrapers
- Spiders
- Data-mining
tools
- Automated
scripts
- Browser
automation
- Bulk
extraction software and
- Similar
technologies.
This restriction does not apply to standard search-engine indexing
conducted in accordance with Prooperty.com’s technical instructions and
Applicable Law.
j. No Unsolicited Marketing
You must not use the Platform or information obtained from it to send:
- Unsolicited
advertisements
- Bulk
promotional messages
- Repeated
sales communications
- Automated
calls or messages
- Misleading
offers
- Phishing
communications or
- Marketing
communications that violate Applicable Law.
Contact information obtained through the Platform must be used only for
legitimate property-related communication connected with the relevant inquiry
or Listing.
k. User Content Review and
Moderation
Prooperty.com may review, moderate, classify, edit, restrict, reject,
suspend, or remove User Content where it reasonably believes that the Content:
- Violates
these Terms & Conditions
- Violates
Applicable Law
- Is
inaccurate or misleading
- Has
been reported by another User
- Infringes
third-party rights
- Creates
a safety or security risk
- Is
outdated or no longer relevant
- Is
duplicated
- Is
technically harmful or
- May
adversely affect the Platform or its Users.
Prooperty.com is not required to review every item of User Content
before publication. The publication of User Content does not constitute
approval, endorsement, verification, or acceptance of responsibility by
Prooperty.com.
l. Cooperation with
Investigations
You agree to reasonably cooperate with Prooperty.com in connection with:
- Complaints
- Fraud
investigations
- Ownership
disputes
- Identity
verification
- Intellectual
property claims
- Law-enforcement
requests
- Regulatory
requirements and
- Other
compliance matters.
This may include providing relevant documents, explanations, contact
details, or evidence of authority.
7. Our Rights Over Submitted
and Listed Content
Users retain ownership of the original Content they lawfully submit to
the Platform. However, Prooperty.com requires certain permissions to host,
display, organise, distribute, and promote that Content.
a. Licence Granted to Prooperty.com
By submitting User Content, you grant Prooperty.com a non-exclusive,
worldwide, royalty-free, transferable, and sublicensable licence to:
- Host
- Store
- Reproduce
- Display
- Publish
- Distribute
- Format
- Adapt
- Translate
- Resize
- Organise
- Index
- Communicate
and
- Promote
the User Content.
This licence is granted only for purposes connected with:
- Operating
the Platform
- Providing
the Services
- Displaying
Listings
- Improving
search and discovery
- Promoting
the Platform
- Communicating
with Users
- Preventing
fraud
- Maintaining
records
- Enforcing
these Terms & Conditions and
- Complying
with Applicable Law.
b. Right to Display and
Format Listings
Prooperty.com may determine how Listings and User Content are:
- Categorised
- Displayed
- Ordered
- Indexed
- Ranked
- Featured
- Filtered
- Resized
- Formatted
- Presented
in search results or
- Made
accessible through the Platform.
Prooperty.com may correct formatting, spelling, layout, image size, or
categorisation without changing the material factual meaning of the Listing. Where
information appears incomplete, inconsistent, or unclear, Prooperty.com may
request clarification or temporarily withhold the Listing.
c. Promotional Use of
Listings
Prooperty.com may use Listing information to promote the Platform or the
relevant Property through:
- Website
pages
- Search
results
- Digital
advertisements
- Social
media channels
- Email
communications
- Mobile
notifications
- Marketing
materials and
- Other
promotional channels operated or authorised by Prooperty.com.
Such use shall remain connected to the operation, marketing, or
promotion of the Platform, its Services, or the relevant Listing.
d. User Warranties
Concerning Content
By submitting User Content, you represent and warrant that:
- You
own the Content or have permission to use it
- You
have authority to grant the licence described in these Terms
- The
Content does not infringe third-party rights
- The
Content does not violate privacy or confidentiality
- The
Content is not fraudulent or misleading
- The
Content complies with Applicable Law and
- Submission
of the Content does not breach any contract or obligation.
You shall remain responsible for claims arising from Content submitted
without proper ownership, authority, consent, or permission.
e. Removal or Suspension of
Content
Prooperty.com may remove, reject, suspend, archive, disable, or refuse
to publish any User Content where:
- It
violates these Terms & Conditions
- It
is reported as fraudulent or misleading
- It
appears outdated or unavailable
- Required
information is missing
- Ownership
or authority is disputed
- It
infringes third-party rights
- It
creates legal or security concerns
- It
duplicates existing Content
- An
applicable fee has not been paid or
- Removal
is required under Applicable Law.
The removal of a Listing does not automatically entitle the User to a
refund unless expressly stated in the applicable Paid Service terms or required
under Applicable Law.
f. Retention of Content
Prooperty.com may retain copies of User Content after removal, Account
closure, or termination where reasonably necessary for:
- Legal
compliance
- Fraud
prevention
- Dispute
resolution
- Recordkeeping
- Enforcement
of rights
- Security
investigations
- Backup
and restoration or
- Compliance
with lawful requests.
Retained Content may not remain publicly visible unless continued
display is legally permitted and operationally necessary.
g. Feedback and Suggestions
Where a User voluntarily submits suggestions, ideas, recommendations, or
feedback relating to the Platform or Services, Prooperty.com may use that
feedback without payment or restriction.
Submitting feedback does not create:
- An
employment relationship
- A
partnership
- A
confidential relationship
- An
ownership interest or
- A
right to compensation.
8. Payment Terms and Refund
Policy
Certain Services offered through Prooperty.com may require payment.
These may include premium Listings, featured placements, subscriptions,
advertisements, promotional packages, or other paid features.
a. Service Fees
The price, features, duration, limitations, and applicable conditions of
a Paid Service will be displayed or communicated before purchase.
Unless otherwise stated:
- Fees
shall be quoted in Indian Rupees
- Applicable
taxes or charges may be added as required by law
- Prices
may vary according to the selected plan, duration, User category, or
Service
- Promotional
prices may be available for a limited period and
- Prooperty.com
may revise future prices at its discretion.
A price revision will not ordinarily affect a Paid Service already
purchased for a confirmed period, unless required by Applicable Law or
expressly agreed with the User.
b. Payment Methods
Payments may be completed through payment options made available on the
Platform, which may include:
- Credit
cards
- Debit
cards
- Net
banking
- Unified
Payments Interface
- Digital
wallets
- Bank
transfers or
- Other
authorised payment methods.
Payments may be processed by independent payment service providers. Prooperty.com
may not directly receive or store complete card or banking credentials where the
transaction is processed through a third-party payment gateway.
c. Payment Authorisation
By initiating a payment, you confirm that:
- You
are authorised to use the selected payment method
- The
payment information provided is accurate
- Sufficient
funds or credit are available
- The
purchase is for a lawful purpose and
- You
agree to the terms of the selected Paid Service.
A Paid Service may be activated only after successful payment
confirmation.
d. Failed, Pending, or
Reversed Payments
A transaction may fail, remain pending, or be reversed due to:
- Incorrect
payment information
- Insufficient
funds
- Bank
or payment-provider restrictions
- Technical
failure
- Security
review
- Payment
cancellation
- Chargeback
- Network
interruption or
- Other
circumstances beyond the control of Prooperty.com.
Where payment has been deducted but the Service has not been activated,
the User should contact Prooperty.com at support@prooperty.com or +91
9854198541 and provide the relevant transaction details. Any reversal or
settlement timeline may depend on the User’s bank or payment service provider.
e. Activation of Paid
Services
A Paid Service shall be treated as activated when:
- The
premium Listing becomes visible
- The
featured placement begins
- The
subscription becomes accessible
- The
advertisement campaign starts
- Paid
credits are added to the Account
- The
purchased feature becomes available or
- Prooperty.com
otherwise begins delivering the purchased Service.
The User is responsible for supplying all information, Content,
documents, and approvals required to activate the Paid Service. A delay caused
by incomplete or inaccurate information submitted by the User shall not
automatically extend the Service period or create a right to a refund.
f. No Guarantee of Leads or
Transactions
Payment for a premium, featured, or promotional Service does not
guarantee:
- A
minimum number of views
- A
minimum number of inquiries
- Qualified
leads
- Contact
from a buyer or tenant
- Completion
of a transaction
- A
specific search position
- A
particular sale or rental price or
- Any
financial or commercial outcome.
Paid Services provide only the features, placement, exposure, duration,
or functionality described at the time of purchase.
g. Subscription Validity
Where a Paid Service is offered for a fixed period:
- The
validity period will begin on the stated activation date
- The
Service will expire at the end of the stated period
- Unused
features or credits may expire unless otherwise stated
- The
Service may not be transferable between Accounts and
- Renewal
may require a separate payment.
Where automatic renewal is offered, the renewal terms, billing
frequency, and cancellation method shall be communicated before the User authorises
recurring payment.
h. Cancellation Requests
A User may submit a cancellation request by contacting support@prooperty.com.
A cancellation request should include:
- The
registered name
- Registered
email address or mobile number
- Account
information
- Order
or transaction reference
- Paid
Service details
- Reason
for cancellation and
- Supporting
information, where relevant.
Submission of a cancellation request does not guarantee cancellation or
refund. Eligibility will depend on the status of the Service, the applicable
purchase terms, and Applicable Law.
i. Refund Eligibility
Refund eligibility shall be determined according to:
- The
terms displayed at the time of purchase
- Whether
the Paid Service has been activated
- Whether
the Service has already been used
- Whether
advertising or promotion has begun
- Whether
any benefits, credits, or leads have been delivered
- Whether
Prooperty.com failed to provide the purchased Service
- Whether
duplicate payment occurred
- Whether
the transaction was unauthorised and
- Requirements
under Applicable Law.
Unless otherwise stated at the time of purchase, fees for Services that
have already been activated, delivered, consumed, or substantially performed
shall be non-refundable, except where a refund is required under Applicable
Law.
j. Duplicate or Excess
Payment
Where a User is charged more than once for the same confirmed purchase,
Prooperty.com may verify the transaction and process an appropriate refund or
adjustment.
The User may be required to provide:
- Bank
or payment statement
- Transaction
reference
- Payment
receipt
- Date
and amount of payment and
- Other
information reasonably required for verification.
k. Refund Processing
Where a refund is approved:
- It
may be returned to the original payment method
- Processing
time may depend on banks and payment providers
- Payment
gateway charges may be treated according to the applicable purchase terms
- Prooperty.com
may deduct the value of Services already delivered where legally permitted
and
- The
User may be required to provide additional verification information.
Prooperty.com shall not be responsible for delays caused by banks,
payment gateways, card networks, or other third-party payment providers.
l. Chargebacks and Payment
Disputes

contact Prooperty.com at support@prooperty.com and
provide a reasonable opportunity to investigate the matter.
Where a chargeback is raised fraudulently or without valid grounds,
Prooperty.com may:
- Suspend
the relevant Account
- Stop
the Paid Service
- Remove
associated Listings
- Recover
unpaid amounts
- Restrict
future purchases or
- Exercise
other rights available under Applicable Law.
m. Invoices and Payment
Records
Prooperty.com may issue an electronic invoice, receipt, or payment
confirmation using the information supplied by the User. The User is responsible
for ensuring that billing information is correct before completing the
purchase. Requests to amend invoices or billing information may be subject to
legal, accounting, or technical limitations.
n. Promotional Offers and
Credits
Promotional discounts, complimentary features, coupons, or credits may:
- Be
available for a limited period
- Apply
only to selected Users or Services
- Be
subject to eligibility conditions
- Be
non-transferable
- Be
limited to one use
- Expire
on a specified date and
- Be
withdrawn where misuse is suspected.
Promotional benefits do not ordinarily have a cash value and are not
refundable unless expressly stated.
o. Taxes and Statutory
Charges
The User shall be responsible for applicable taxes, duties, levies,
registration charges, or statutory costs connected with:
- The
purchase of Paid Services
- The
User’s business activity
- A
property transaction or
- Payments
made between Users.
Prooperty.com is not responsible for calculating or collecting taxes
arising from transactions independently entered into between Users, except
where required by Applicable Law.
9. Prohibited Uses
Users must access and use the Platform only for lawful property-related
purposes and in accordance with these Terms & Conditions. You must not use,
attempt to use, assist another person in using, or permit the use of the
Platform for any activity prohibited under this section.
a. False Identity and
Impersonation
You must not:
- Impersonate
another individual, property owner, Broker, Agent, Builder, Developer, business,
or organisation
- Create
an Account using false, fabricated, stolen, or misleading identity
information
- Misrepresent
your professional role, qualifications, authority, employment, or
affiliation
- Use
another person’s photograph, contact details, documents, or credentials
without lawful permission
- Falsely
claim to be the Owner or authorised representative of a Property
- Present
yourself as an employee, representative, partner, or authorised associate
of Prooperty.com without written authorisation or
- Conceal
your identity or role for fraudulent, deceptive, or unlawful purposes.
b. Fraudulent or Misleading
Listings
You must not publish, promote, submit, or communicate any Listing that:
- Relates
to a Property that does not exist
- Relates
to a Property that is not available for the stated purpose
- Uses
false ownership or authorisation claims
- Contains
an intentionally incorrect price
- Misrepresents
the Property’s location, dimensions, condition, status, or amenities
- Uses
photographs or videos of an unrelated Property
- Conceals
material defects, disputes, restrictions, or charges
- Falsely
presents a resale Property as a new Property
- Falsely
presents a Broker or Agent Listing as an Owner Listing
- Creates
an artificial sense of urgency or scarcity
- Is
designed to obtain money or sensitive information through deception or
- Promotes
a transaction prohibited under Applicable Law.
c. Unauthorised Property
Representation
You must not advertise, list, market, negotiate, or communicate
regarding a Property unless you possess the legal authority required to do so.
You must not:
- List
a Property without the knowledge or permission of the lawful Owner
- Continue
advertising a Property after your authority has expired or been withdrawn
- Submit
documents that have been forged, altered, or obtained unlawfully
- Misrepresent
the scope of your authority
- Collect
booking amounts, deposits, brokerage fees, or other payments without
lawful authorisation
- Claim
exclusive rights over a Property without a valid basis or
- Act
as an intermediary where such activity requires a registration, licence,
or approval that you do not possess.
d. Duplicate Listings and
Search Manipulation
You must not attempt to manipulate the visibility, ranking, discovery,
or presentation of Listings.
Prohibited conduct includes:
- Publishing
multiple Listings for the same Property without a legitimate reason
- Repeatedly
deleting and reposting a Listing to obtain higher visibility
- Changing
minor details to avoid duplicate-content detection
- Using
unrelated locations or property categories to increase exposure
- Adding
irrelevant keywords to Listing descriptions
- Publishing
the same Property through multiple Accounts to create false availability
- Artificially
generating views, clicks, inquiries, reviews, or interactions
- Coordinating
with other Users to manipulate Platform activity or
- Attempting
to interfere with search, recommendation, ranking, or moderation systems.
Prooperty.com may remove duplicate Listings, reduce their visibility,
combine related Listings, restrict the relevant Account, or take other
appropriate action.
e. Unlawful Collection of
Payments
You must not use the Platform to request, receive, collect, transfer, or
facilitate payments where:
- You
are not legally authorised to collect the payment
- The
payment request is based on false or misleading information
- The
purpose of the payment has not been clearly disclosed
- The
Property or transaction does not exist
- The
recipient’s identity is concealed or misrepresented
- The
payment is connected with unlawful activity
- The
payment request violates Applicable Law or
- The
User is being pressured to make an immediate payment without a reasonable
opportunity to verify the transaction.
Users should independently verify the identity, authority, banking
details, documentation, and purpose of any requested payment.
f. Unauthorised Access and
Security Violations
You must not attempt to gain unauthorised access to:
- Any
Account
- Any
restricted area of the Platform
- Prooperty.com’s
servers, systems, databases, or networks
- Information
belonging to another User
- Administrative
functions
- Source
code or non-public technical information
- Authentication
systems or
- Any
connected service or infrastructure.
You must not:
- Attempt
to obtain another User’s password, verification code, or login information
- Test,
scan, or probe the vulnerability of the Platform without written
authorisation
- Bypass
security, authentication, rate-limiting, or access-control measures
- Exploit
a security vulnerability
- Intercept
Platform communications
- Use
stolen or unlawfully obtained credentials
- Attempt
to reverse-engineer security mechanisms or
- Assist
another person in carrying out any unauthorised access.
Any suspected security weakness should be reported responsibly to support@prooperty.com without
exploiting, publicly disclosing, or using the weakness for personal benefit.
g. Harmful Software and
Technical Interference
You must not upload, transmit, introduce, distribute, or cause the introduction
of:
- Viruses
- Malware
- Ransomware
- Spyware
- Trojan
horses
- Worms
- Corrupted
files
- Malicious
scripts
- Harmful
links
- Automated
attack tools or
- Any
code intended to damage, disrupt, monitor, alter, or gain unauthorised
access to a system or device.
You must not interfere with the normal operation, availability,
integrity, performance, or security of the Platform.
Prohibited interference includes:
- Denial-of-service
activity
- Excessive
automated requests
- Server
overload attempts
- Interference
with network communications
- Deliberate
introduction of technical errors
- Disruption
of another User’s access
- Manipulation
of Platform data or
- Any
activity that places an unreasonable burden on the Platform’s
infrastructure.
h. Scraping and Data Extraction
You must not collect, copy, download, reproduce, monitor, or extract
Platform data through automated or systematic means without prior written
permission from Prooperty.com.
This prohibition applies to the use of:
- Bots
- Crawlers
- Spiders
- Scrapers
- Data-mining
software
- Browser
automation tools
- Automated
scripts
- Artificial
intelligence training tools
- Bulk
downloading software
- Contact-extraction
tools or
- Similar
technology.
You must not use Platform data to:
- Build
or improve a competing property platform
- Create
an independent property database
- Resell
or redistribute Listing information
- Train
a commercial data model without permission
- Compile
User contact information
- Conduct
unauthorised market surveillance
- Republish
Listings on another service or
- Generate
unsolicited marketing databases.
Standard indexing by recognised search engines may be permitted where it
complies with Prooperty.com’s technical instructions and does not interfere
with the Platform.
i. Unauthorised Commercial
Use
You must not use the Platform for a commercial purpose that is not
expressly permitted by these Terms & Conditions or by a separate written
agreement with Prooperty.com.
Prohibited commercial use includes:
- Reselling
access to the Platform
- Selling
Platform data
- Charging
another person for access to publicly available Platform features
- Replicating
the Platform’s Services
- Creating
a competing Listing service using Platform Content
- Using
User contact details for unrelated commercial activities
- Promoting
unrelated products or services
- Operating
an unauthorised referral or lead-resale scheme
- Using
Platform inquiries to divert Users to a deceptive service or
- Exploiting
Platform features for undisclosed financial gain.
j. Spam and Unsolicited
Communications
You must not use the Platform or contact information obtained through it
to send:
- Spam
- Bulk
messages
- Repeated
unwanted communications
- Unsolicited
promotional messages
- Automated
calls or messages
- Phishing
messages
- Fraudulent
offers
- Unrelated
commercial advertisements
- Misleading
links or
- Communications
prohibited under Applicable Law.
Property-related contact information may be used only for legitimate
communication connected with the relevant Listing, inquiry, or transaction. A
User must stop contacting another User where the recipient clearly requests
that further communication cease, unless continued communication is legally
required.
k. Harassment, Abuse, and
Threatening Conduct
You must not use the Platform to:
- Harass,
threaten, intimidate, stalk, or abuse another person
- Send
insulting, degrading, or repeatedly unwanted messages
- Publish
private information to cause harm
- Encourage
violence or unlawful conduct
- Make
discriminatory or hateful statements
- Extort
or pressure another User
- Retaliate
against a User who submits a complaint
- Make
knowingly false allegations or
- Interfere
with another person’s lawful use of the Platform.
l. Infringement of
Third-Party Rights
You must not upload, publish, distribute, or use Content that infringes
or violates another person’s:
- Copyright
- Trademark
rights
- Design
rights
- Database
rights
- Confidential
information
- Contractual
rights
- Privacy
rights
- Publicity
rights
- Moral
rights or
- Any
other legal or proprietary rights.
You are responsible for obtaining all permissions, licences, consents,
and authorisations required before submitting third-party Content.
m. Misuse of Reviews,
Ratings, or Feedback
Where the Platform permits reviews, ratings, recommendations, or
feedback, you must not:
- Submit
a review regarding an experience that did not occur
- Provide
false or misleading feedback
- Offer
or accept payment in exchange for a favourable review
- Threaten
another User with a negative review
- Submit
multiple reviews through different Accounts
- Coordinate
artificial ratings
- Publish
personal attacks unrelated to a genuine transaction
- Disclose
confidential or sensitive information or
- Use
reviews to manipulate reputation or search visibility.
Prooperty.com may remove or restrict reviews that appear fraudulent,
irrelevant, abusive, incentivised, or inconsistent with these Terms &
Conditions.
n. Circumvention of
Platform Rules
You must not attempt to bypass:
- Account
restrictions
- Listing
limits
- Payment
requirements
- Verification
procedures
- Content-moderation
systems
- Security
controls
- Geographic
restrictions
- Subscription
conditions
- Suspension
decisions or
- Any
other Platform limitation.
Creating a new Account after suspension or termination, without written
permission from Prooperty.com, may be treated as a further violation.
o. Unlawful or Restricted
Activities
The Platform must not be used to facilitate:
- Money
laundering
- Fraud
- Identity
theft
- Forgery
- Cybercrime
- Tax
evasion
- Unlawful
financial activity
- Unauthorised
collection of personal data
- Sale
or lease of unlawfully occupied Property
- Transactions
prohibited by a court or governmental authority
- Concealment
of unlawful funds
- Breach
of sanctions or legally binding restrictions or
- Any
activity prohibited under Applicable Law.
p. Monitoring and Enforcement
Prooperty.com may investigate suspected violations using information
lawfully available to it, including:
- Account
activity
- Listing
information
- User
complaints
- Communication
records available through the Platform
- Verification
documents
- Device
and access information
- Payment
records
- Moderation
findings and
- Information
received from lawful authorities.
Where a violation is suspected or established, Prooperty.com may:
- Issue
a warning
- Request
clarification or documentation
- Remove
or restrict Content
- Reduce
Listing visibility
- Suspend
or terminate an Account
- Cancel
access to a Service
- Restrict
future registration
- Preserve
relevant records
- Report
suspected unlawful activity to the appropriate authority or
- Exercise
any other right available under these Terms & Conditions or Applicable
Law.
The exercise of one remedy does not prevent Prooperty.com from
exercising another available remedy.
10. Intellectual Property
Rights
The Platform contains intellectual property owned by, licensed to, or lawfully
used by Prooperty.com. Except for User Content and third-party material, all
rights, title, and interest in the Platform and the Content created or made
available by Prooperty.com belong to Prooperty.com, subject to
Applicable Law.

original materials created for the Platform.
Such materials may be protected by copyright, trademark, design,
database, confidentiality, contractual, and other intellectual-property
principles under Applicable Law.
b. Ownership of the
Prooperty.com Brand
The name Prooperty.com, its logo, visual identity, slogans,
domain name, and associated brand elements are owned by or lawfully used by
Prooperty.com. Nothing in these Terms & Conditions grants a User any
ownership interest or unrestricted right to use the Prooperty.com name or
branding.
You must not, without prior written permission:
- Use
the Prooperty.com name or logo for commercial purposes
- Create
a confusingly similar name, logo, domain, or social-media identity
- Represent
that Prooperty.com endorses or sponsors you
- Register
a domain name containing or imitating the Prooperty.com name
- Use
the branding in deceptive advertisements
- Alter
or remove brand notices
- Copy
the visual identity of the Platform or
- Use
the brand in a manner likely to cause confusion.
The absence of a registration symbol does not constitute permission to
use any brand element.
c. Limited Permission to
Use the Platform
Subject to compliance with these Terms & Conditions, Prooperty.com
grants you a limited, personal, non-exclusive, non-transferable, non-sublicensable,
and revocable permission to access and use the Platform for lawful purposes
connected with the Services.
This permission does not transfer ownership of any intellectual property
to you.
You may use the Platform only:
- Through
authorised interfaces
- For
legitimate property-related purposes
- In
accordance with the available features
- For
your personal or authorised business requirements and
- In
compliance with these Terms & Conditions and Applicable Law.
d. Restrictions on Use of
Platform Materials
Unless Prooperty.com provides prior written permission, you must not:
- Copy
substantial portions of the Platform
- Reproduce
Platform Content
- Republish
articles, guides, or Listing compilations
- Modify
or create derivative works from Platform materials
- Distribute
or commercially exploit Platform Content
- Sell,
license, rent, or transfer Platform materials
- Remove
copyright, attribution, or ownership notices
- Frame
or mirror Platform pages
- Embed
Platform Content on another website
- Copy
the Platform’s design, arrangement, or functionality
- Reverse-engineer
software or technical systems
- Decompile,
disassemble, or attempt to derive source code
- Use
Platform Content to train a commercial artificial intelligence system
- Use
Platform data to create a competing service or
- Present
Platform Content as your own work.
e. Permitted Personal Use
A User may view, access, and use publicly available Platform Content for
legitimate personal property-search or property-management purposes.
Limited downloading, printing, or saving may be permitted where:
- It
is reasonably necessary for personal reference
- The
Content is not modified
- Ownership
and attribution notices remain intact
- The
material is not republished or commercially exploited
- Personal
information is handled responsibly and
- The
use complies with Applicable Law.
This permission does not apply to bulk copying, systematic extraction,
republication, resale, or creation of an independent database.
f. Ownership of User
Content
Users retain ownership of original User Content they lawfully create and
submit.
Submission of User Content does not transfer ownership to Prooperty.com.
However, the User grants Prooperty.com the licence described in Section 7 so
that the Content may be hosted, displayed, distributed, adapted, promoted,
moderated, and otherwise used for operating the Platform.
The User remains responsible for ensuring that:
- The
User owns the submitted Content
- The
User has obtained all required permissions
- The
Content does not infringe third-party rights
- Required
individuals have consented to publication
- Confidential
information has not been disclosed unlawfully and
- The
Content may lawfully be used for the stated purposes.
g. Property Images and
Marketing Material
A User submitting photographs, videos, floor plans, brochures, project
material, or other promotional Content confirms that the User has authority to
publish that material.
Where Content has been created by a:
- Photographer
- Architect
- Designer
- Marketing
agency
- Property
consultant
- Builder
- Developer
- Previous
Owner or
- Other
third party,
the User must obtain any licence, assignment, permission, or consent
required for its use on the Platform. Payment for the creation of material does
not necessarily establish that the User owns every intellectual-property right
in that material.
h. Third-Party Intellectual
Property
Names, logos, photographs, documents, project names, maps, or other
material belonging to third parties remain the property of their respective
owners.
Their appearance on the Platform does not automatically mean that:
- Prooperty.com
owns the material
- Prooperty.com
is commercially associated with the owner
- The
owner endorses Prooperty.com
- Prooperty.com
endorses the owner or
- A
licence exists beyond the purpose for which the material is displayed.
Users must not rely on the availability of third-party Content as
evidence that it may be copied or reused elsewhere.
i. Reporting
Intellectual-Property Concerns
A person who believes that Content on the Platform infringes intellectual-property
rights may contact support@prooperty.com.
The notice should contain sufficient information to allow the matter to
be reviewed, including:

name and contact details of the complainant
- Identification
of the protected work, brand, or material
- Identification
of the allegedly infringing Content
- The
location of the Content on the Platform
- An
explanation of the complainant’s rights
- Supporting
registration, ownership, licence, or authorisation documents

Incomplete, unsupported, misleading, or fraudulent complaints may not be
processed.

After receiving a sufficiently detailed complaint, Prooperty.com may:

the User who submitted the Content
- Temporarily
restrict the disputed Content
- Remove
the Content
- Restore
the Content where the complaint is not established
- Preserve
relevant records
- Restrict
repeat infringers
- Suspend
or terminate an Account or
- Take
other appropriate action under Applicable Law.
Prooperty.com does not act as a court or final authority for determining
ownership disputes. Where the parties disagree regarding ownership, validity,
licensing, or infringement, they may be required to resolve the matter directly
or through the appropriate legal process.
k. Feedback, Suggestions,
and Product Ideas
Where you voluntarily provide ideas, feedback, comments, feature
requests, recommendations, or suggestions relating to the Platform, you permit
Prooperty.com to consider and use them for purposes such as:
- Improving
the Platform
- Developing
new Services
- Enhancing
existing tools
- Addressing
technical issues
- Improving
user experience or
- Supporting
business operations.
Unless separately agreed in writing, submission of feedback does not
create:
- A
right to payment
- A
right to ownership
- A
confidential relationship

employment relationship

partnership

cannot guarantee the outcome of a third-party payment investigation.

The Platform may display maps, location markers, estimated distances,
neighbourhood details, or route information obtained from Users, external
sources, or technical integrations.
Such information may be approximate and may be affected by:

- Outdated

- User-submitted

- Traffic
conditions
- Geographic
boundaries

Users should independently confirm the exact Property location, access

Prooperty.com does not guarantee that a User will:

a legal process

a specific service outcome or
- Be
satisfied with the third party’s performance.
Any service agreement, payment, eligibility decision, or professional
advice shall remain between the User and the relevant third party.

Advertisements
The Platform may display advertisements or sponsored Content supplied by
third parties. Advertisers are responsible for ensuring that their
advertisements are:

Prooperty.com may not review every external link and does not guarantee

to the Listing or
- Operated
by the person represented.
Users should exercise caution before opening unfamiliar links,
downloading files, entering login credentials, or sharing personal or financial
information.
k. Third-Party Service
Interruptions
Prooperty.com shall not be responsible for the unavailability, delay,
suspension, failure, or discontinuation of a third-party service where the
matter is outside Prooperty.com’s reasonable control. The Platform may
temporarily lose functionality where an essential integration becomes unavailable.
Prooperty.com may replace, modify, suspend, or remove a third-party integration
without prior notice where reasonably necessary.
l. Disputes with Third

User’s direct interaction with a third party should ordinarily be addressed

shall be limited to the delivery of the features expressly included in that

k. Maximum Aggregate
Liability
Where Prooperty.com’s liability cannot be excluded under Applicable Law,
its total aggregate liability for a claim arising from a specific Paid Service
shall not exceed the amount actually paid by the User to Prooperty.com for that
specific Service during the twelve months immediately preceding the event
giving rise to the claim.
Where no amount was paid for the relevant Service, Prooperty.com’s
liability shall be limited to the minimum extent permitted under Applicable
Law.
l. User Responsibility to
Minimise Loss
A User who becomes aware of an error, suspected fraud, unauthorised
access, misleading Listing, or other risk must take reasonable steps to prevent
or minimise further loss.

after the User becomes aware of the relevant risk and fails to take reasonable

14. Indemnification
You agree to indemnify, defend, and hold harmless Prooperty.com, its
officers, employees, representatives, authorised affiliates, and service
providers from claims, liabilities, losses, damages, penalties, costs, and
expenses arising from your conduct or use of the Platform.

of confidential information

of personal information without consent
- Violation

d. Financial and Payment

You shall indemnify Prooperty.com against claims arising from:

f. Urgent Fraud or Payment

Where a User suspects fraud or has made a payment to an unauthorised
person, the User should act promptly.
Recommended steps may include:

that the transaction be stopped or reviewed

the User’s Account

Reporting the matter to Prooperty.com does not replace the need to
contact the bank, payment provider, police, cybercrime authority, or another
competent authority.

- Bank

- Contact

Deleting or altering evidence may limit the ability of Prooperty.com or

Where Content or conduct presents an immediate threat to personal
safety, property, or public security, Users should contact the appropriate
emergency or law-enforcement authority without delay. Prooperty.com may take
Platform-related action but is not a replacement for emergency services,
law-enforcement agencies, courts, or regulatory authorities.
i. Confidentiality of
Reports
Prooperty.com may treat reports and supporting information as
confidential to the extent reasonably possible.
However, information may be disclosed where necessary to:

17. Termination of Access
Prooperty.com may suspend, restrict, deactivate, or terminate a User’s
access to the Platform or any Service where reasonably necessary to protect the
Platform, comply with Applicable Law, prevent misuse, or enforce these Terms

- Submitted
an unauthorised, fraudulent, or deceptive Listing
- Misrepresented
ownership, identity, authority, or affiliation
- Used
the Platform for an unlawful purpose
- Attempted
to defraud Prooperty.com or another User
- Collected
or requested payments without lawful authority
- Infringed
intellectual-property, privacy, or other third-party rights
- Used
the Platform to send spam or unsolicited communications
- Harassed,
threatened, or abused another User
- Attempted
to gain unauthorised access to the Platform or another Account
- Introduced
malware, harmful code, or a security threat
- Used
automated tools to extract or reproduce Platform data
- Manipulated
Listings, reviews, inquiries, visibility, or search results
- Avoided
payment obligations
- Initiated
an unjustified or fraudulent chargeback
- Failed
to provide requested verification information
- Created
multiple Accounts to avoid restrictions
- Continued
using the Platform after a previous suspension
- Caused
legal, financial, operational, security, or reputational risk or
- Engaged
in conduct prohibited under Applicable Law.
b. Immediate Protective
Action
Prooperty.com may take immediate action without prior notice where delay

- Expose
another User to fraud or financial loss
- Create
a safety or security risk
- Permit
unlawful activity to continue
- Compromise
Platform systems or data
- Interfere
with an investigation
- Breach
a legal or regulatory obligation
- Result
in destruction or alteration of evidence or

material harm to Prooperty.com or a third party.
Immediate action may include:

- Suspending

Temporary protective action does not constitute a final determination of
liability or wrongdoing.

- Account-linked
data may no longer be available to the User and

User must stop representing that the Account remains active.
Account closure does not automatically cancel obligations or liabilities
that arose before closure.
g. Paid Services Following
Termination
Suspension or termination caused by a User’s breach of these Terms &
Conditions does not automatically entitle the User to:
- A
refund
- An
extension
- Transfer
of the Paid Service
- Replacement
promotional credits
- Compensation
for lost visibility or
- Restoration
of unused benefits.
Any refund shall be determined according to the applicable Paid Service
terms, the reason for termination, the extent of Services already delivered,
and Applicable Law. Where Prooperty.com discontinues a Paid Service for reasons
unrelated to the User’s conduct, an appropriate adjustment, replacement,
credit, or refund may be considered according to the applicable purchase terms.
h. Outstanding Obligations
Termination does not affect any obligation that arose before the

A User whose Account has been permanently terminated must not create or

same email address

same business

same device

same payment method

Conditions does not automatically make Prooperty.com a party to an independent
dispute between Users. Prooperty.com may take Platform-related action or
provide records where legally permitted, but does not become responsible for
resolving the underlying dispute.

right to approach a court, tribunal, consumer forum, regulator, or authority

g. User Contact Information
Users are responsible for maintaining accurate and active contact
information in their Accounts.
Prooperty.com shall not be responsible for missed notices caused by:
- An
outdated email address
- An
inactive mobile number
- A
full email inbox
- Spam
filtering
- Incorrect
Account details
- Device
restrictions or
- Failure
to review Platform notifications.
h. Response Times
Prooperty.com will use reasonable efforts to respond to communications
within an appropriate period.
Response times may vary depending on:
- The
nature of the issue
- The
completeness of the information provided
- The
need for verification
- The
involvement of another User
- The
complexity of the complaint
- Third-party
dependency
- Legal
requirements or
- The
need to preserve or investigate records.
No stated or estimated response time shall constitute a guarantee unless
required under Applicable Law.
22. Acknowledgement and
Copyright Notice
a. User Acknowledgement
By accessing, browsing, registering on, posting Content to, purchasing
Services through, or otherwise using the Platform, the User acknowledges and confirms
that:
- The
User has read these Terms & Conditions
- The
User understands the rights and obligations described in them
- The
User agrees to comply with these Terms & Conditions
- The
User has reviewed or had the opportunity to review the Privacy Policy
- The
User is legally capable of entering into this Agreement
- The
User is responsible for information submitted through the Platform
- The
User understands that Prooperty.com primarily operates as a digital
property-information and communication Platform
- The
User understands that Prooperty.com does not guarantee the completion or
outcome of a property transaction
- The
User will conduct independent verification before making a payment or
entering into a transaction and
- The
User accepts that continued use of the Platform is subject to the current
version of these Terms & Conditions.
b. Entire Agreement
These Terms & Conditions, together with the Privacy Policy and any
applicable service-specific terms, constitute the entire agreement between Prooperty.com
and the User concerning use of the Platform. They replace prior discussions,
representations, understandings, or communications relating to the same subject
matter, except where a separate written agreement has been validly executed.
c. Severability
If any provision of these Terms & Conditions is held to be invalid,
unlawful, or unenforceable by a competent authority:
- The
affected provision shall be interpreted or limited to the minimum extent
necessary
- The
remaining provisions shall continue in full force and effect
- The
validity of the remaining Agreement shall not be affected and
- The
parties shall seek to preserve the original legal and commercial intention
as far as permitted.
d. No Waiver
Failure or delay by Prooperty.com in enforcing any right or provision
shall not constitute a waiver of that right or provision.
A waiver shall be valid only where it is:
- Expressly
stated
- Made
in writing and
- Authorised
by Prooperty.com.
A waiver concerning one breach shall not constitute a waiver concerning
another or later breach.
e. Assignment
Users may not assign, transfer, delegate, or otherwise dispose of their
rights or obligations under these Terms & Conditions without prior written
consent from Prooperty.com. Prooperty.com may assign or transfer its rights and
obligations where reasonably necessary in connection with:
- Corporate
restructuring
- Business
transfer
- Merger
- Acquisition
- Sale
of assets
- Operational
reorganisation
- Legal
compliance or
- Transfer
to an authorised successor.
Any assignment shall remain subject to Applicable Law.
f. No Partnership or Agency
Use of the Platform does not create any:
- Partnership
- Joint
venture
- Employment
relationship
- Franchise
- Fiduciary
relationship
- Agency
relationship or
- Authority
to bind Prooperty.com.
No User may make commitments, representations, warranties, or promises
on behalf of Prooperty.com without prior written authority.
g. Headings
Section titles, subsection headings, and formatting are provided for
convenience and readability. They shall not limit, expand, or otherwise affect
the interpretation of these Terms & Conditions.
h. Interpretation
Unless the context requires otherwise:
- Words
in the singular include the plural
- Words
in the plural include the singular
- References
to a person include individuals and legal entities
- The
words “including” and “includes” mean “including without limitation”
- References
to laws include amendments, replacements, and subordinate rules
- References
to written communication include valid electronic communication and
- References
to the Platform include Services made available through it.

The copyright in the original Content, design, arrangement, structure,
and materials created for the Platform is owned by Prooperty.com, unless

exploit, or create derivative works from protected Platform Content without
prior written permission.

l. Final Acceptance
By continuing to access or use the Platform, the User confirms
acceptance of these Terms & Conditions in their entirety. A User who does
not accept these Terms & Conditions must immediately stop using the
Platform and may request Account closure by contacting support@prooperty.com.
